If LE stops you and they find a bunch of condoms doing an illegal search, so what?
You shouldn't and also DO NOT have to talk to LE other than by identifying yourself actually, you don't even have to do that but keep in mind they may detain you for not telling them who you are too(they have 48 hrs to charge on a ProbabableCause hold) if you aren't talking they have nothing. Silence is your friend, LE is not in that situation.-V

OT - but I find it worth a laugh. Female driver was recently cited for reckless operation. Seems she had a vibrating egg inserted, got excited and lost control of her car. She claimed she was independent contractor for Intimate Treasures (or something like that - adult Avon parties) and was enroute to a function. She further claimed she wanted to try this item out in order to offer up personal observation.

How true. I grew up with members of my family being in LE and always thought "Why not talk to LE I've got nothing to hide"

Then as part of the bonus of finding this site I clicked on Anabangbang's links for the escourtdrama site and watched the 2 video's by the law professor and the detective. Now I'm like hell I don't know if I'll ever talk to a member of LE again even conversationally.

One thing I've known for years though. Is never ever hang out at a bar who's customers tend to be LE. Because no matter how in the right you are you'll have the brotherhood backing the other guy everytime. I don't know this from personal experience thank god.

I actually grounded my son all of last summer for talking to them,
It was the fact LE was trying to pin a felony arson on him just bc he went to see where the smoke was coming from while on the phone w/h the fire dept LE spots him, handcuffs him and drags him downtown without even telling me and put words in his mouth.*note he has asbergers syndrome

But - thats IF we even talked, we are of the opinion that 90% of people inadvetently incriminate themselves by TALKING! So, we refuse to talk.

We patently refuse searches, roadside sobriety tests, etc. all of these things are designed to get you into trouble - if a cop pulls me over he has to have reason. Further, if we do pull over, it will be into a well lit, well populated busy parking lot. Much harder for cops when there are 10 civillian witnesses.

a condom is used as evidence because there are 2 elements needed for most criminal convictions.

1. Actus reus - the criminal activity
2. Mens rea - the criminal intent

the first element is satified by the agreement.. ..making an agreement to exchange a sex act for something of value is the criminal activity (actus reus) in a prostiution charge... .. . money doesnt have to be involved, sex doesnt have to be involved, only an agreeement.

the second element (mens rea) is satified by an act of "furtherance". .. having condoms shows that you not only agreed to the act, but you actually intended to go through with, or "further" the act.

another example of an act of "furtherance" is starting to get undressed but that doesnt mean they are arresting any woman who takes off her jacket in public.

scenario:
undercover officer says: "would you have sex with me for $300"
girl says: "sure" and laughs.

she's arrested.
later, in court
she says: "yeah i agreed, but i thought he was just joking around and i was playing along, i was laughing".
officer: "well she came to the hotel with a purse full of condoms".

so yes, condoms can be used against you as evidence.
but mere possession of condoms alone will NOT get you arrested.

by trying to incite a riot over this condom issue which is actually very legally reasonable, they are just taking the focus away from the real issues that we have and it's just going to make it harder for us to have credibility with legislators in the future.
